ABSTR ACT
The regul ation of carriage of goo ds by sea contracts ha s evolved from a
system of absolut e freedom of agr eements towards a l imitation of fr eedom
of the parti es. Legislation in Sp ain and Colombia follows thi s evolution
to internat ional legislat ion (The Hague Vi sby Rules, The Hambu rg Rules
and the rec ent Rotterdam Rules). Spanish Shipp ing Act 2014 and some
rules i n Colombian Comme rcial Code show th is trend. Under the cu rrent
legislation i n Spain and Colombia, the whole ca rriage of goods by sea
contracts a re built over the tr ansport obl igation, as the ma in comm it-
ment in the cont ract, even in af freightment (Spani sh Shipping Act 2014).
