Abstract: The establishment of a formal hierarchy between domestic
and internationa l tribunals has tradit ionally been a “taboo” for inter-
national legal scholars and operators of the domestic and international
legal systems. However, it is possible and desirable to envisage hiera rchy
between domestic and intern ational tribu nals. Hierarchy is a strong
mechan ism that permits the ef cient enforcement of jud icial decisions
and the avoidance of all t ypes of conicts between the judicia l organs
operating wit hin a legal order. It also fosters the un iformity and predict-
ability in t he application and inter pretation of the same body of legal
rules by many different t ribunals. Finally, hierarchy is a strong i ncentive
for the observance of equality before the law of the actors in judicial
proceedings. Bot h domestic and international tr ibunals have already used
hierarchica l tools when faced with the regulation of thei r relationships.
Consequently, it appears that the establish ment of a hierarchy between

in their judicial practice.

Jerarquía entre tribunales internos e internacionales:
¿utopía o futuro cercano?
Resumen: el establecimiento de una jerarquía formal entre tribunales
internos e internacionales ha sido un “tabú” para los estudiosos del
derecho intern acional y los actores de los sistemas jurídicos i nterno e
internacional. No obstante, es posible y deseable pensar las relaciones
ent re órg anos ju di cia les in te rn os e int er naci onal es en té rm ino s jer árqui cos.
La jer arqu ía pe rm ite l a ej ec uc ión eca z de las se nt enci as de lo s tr ibuna les
que operan en un deter minado orden jurídico y evit a el surgimi ento de
todo t ipo de con icto s entr e dicha s ju risd icc ion es. Ad icional ment e, est a
refuerza la uni formidad y la certeza en la interpret ación y aplicación de las
mis mas norm as y prin cipios ju rídicos por pa rte de mú ltiple s y di stinto s
tribunales. Por últ imo, la jerarquía garantiza la igualdad ante la ley de
los intervinientes en los procedimientos contenciosos ante los órganos
jud ici ales . Tanto lo s tr ibu na les inte rnos co mo los int erna cion ales ya ha n
utilizado mecanismos jerárquicos para regular sus relaciones. En con-
secuencia, puede comprobarse que el establecimiento de jerarquía entre
tribunales i nternos e internacionales no es utópica, si no una tendencia
existente en su quehacer judicia l respectivo.

de direito intern acional , assim como para os atores do sistema juríd ico
in te rn o e do ord enam ento jur ídi co int erna cion al. No en ta nto, é pos síve l

e desejável, p ensa r as rel ações entre órgãos jud icia is internos e inte rna-
cionais de forma hierárquica. A hierarquia permite a execução ecaz das
sentenças dos tribunais, que opera em uma determinada ordem jurídica e
ev ita o su rgi ment o de tod o tipo de con it os ent re jur isd õe s. Adi cion al-
mente, a hierarquia reforça a uniform idade e a certeza na interpretação
e apl icaçã o das mes mas nor mas e pr incíp ios jur ídico s por par te de mú l-
tiplos e distintos t ribunais. Finalmente, a h ierarquia garante a igu aldade
perante a lei, dos envolvidos em procedimentos contenciosos perante os
órgãos judiciais. Tanto os tribunais internos quanto os internacionais
já uti lizaram mecan ismos hierá rquicos para reg ular mutuamente suas
relações. Consequentemente, pode-se comprovar que o estabelecimento
de um a hiera rqu ia entre tri bunais int ernos e i nter nacion ais não se tra ta
de uma evolução utópica, mas sim de uma tendência já existente em suas
respectivas rotin as judiciais.

Introduction
Hierarchy is the archet ype of all lega l reasoning.1 Law can fu nction as
a system because its parts relate to one another by complex formal and
vertica l relationship s. All domestic legal orders are bu ilt upon normat ive
and institut ional hierarchy. Thus, the val idity of a given lega l system’s
norms derives from hierarch ically higher norms.2 In the same sense,
the State’s leg islative, execut ive, a nd judicia l powers have hierarchical
structures. In particular, the organ ization of the domestic jud iciaries
takes the form of a hierarchy bet ween higher courts a nd lower courts,
which const itutes the so-called judicia l system.
In Com mon La w coun tries , th e oper atio n of the dom estic ju dic ia l
system’s hierarchy is strengthened by the stare dec isis doctrine.3 By v irtue
