Resumen
La participación como dispositivo amplificador del tipo es un mecanismo para imponer
la sanción penal, manteniendo indemne el principio de legalidad, el principio del acto y,
a la vez, evitando la impunidad.
Su estudio fue objeto de l a extensión interpretat iva propia de la teoría de la equ ivalencia
de las condiciones, la cual proveía un concepto unitario de autor, sin distinguirlo del
participe en cuan to a la pena a imponer y, por ende, negó la existencia de l a importancia
del aporte; siendo super ada, posteriormente, por el análisis re strictivo realizado por las
teorías subjetivas, l as cuales fueron desplazadas por las teor ías objetivas; pero ambas,
encaminadas a brinda r criterios para diferenciar (de limitar) la autoría y la part icipación;
e igualmente, ambas sometidas a críticas, de las cuales surge la imposición de la
teoría del dominio del hecho; tesis que fue desarrollada por elementos como el dominio

positivo y objetivo del hecho, y como el injusto culpable. La teoría del dominio del
hecho fue retomada y cr iticada por Schünemann, en cuanto a los delit os de infracción
de deber y en su lugar propone un concepto tipológico distinto.
De cara al futuro se v islumbra una incertidumbre enc abezada por el normativismo más
puro, que aunque distinto a la teoría de la equivalencia, sí coinciden en una postura
unificadora de cara al autor y al participe; punto al que llega la teoría normativista
gracias a una valoración global del conjunto de aportes que enmarcaron la conducta,
olvidándose de la relevancia individual de cada uno de los intervinientes y lo que
representan para la conducta misma.

Abstract
As an amplify ing device of the criminal act, the p articipation is a mechanism to impos e
the penal sanction, kee ping the principle of legality, the principl e of the act and, at the
same time, avoiding impunity.
Its study was subject to the interpretative extension of the theory of equivalence
of conditions, which provided a unitary concept of author -without distinguishing it
from the participant in terms of the penalty to impose- and, therefore, denied the
importance of the contribution. This conception was overcome, later, by the restrictive
analysis of the subjective theories, which were displaced by the objective theories; but
both, aimed at providing criteria to differentiate (delimit) authorship and participation;
and equally, both subjected to criticism, from which arises the theory of the domain
of the fact. This last was developed by elements such as the positive and objective
domain of the act, and as the unjust culprit. The thesis was retaken and criticized
by Schünemann, regarding the offenses of duty infringement and instead proposes a
different concept.
Looking to the fu ture, an uncertainty is gli mpsed, led by the purest normativ ism, which,
although different from the theory of equivalence, does coincide in a unifying position
facing the author and t he participant; point at which nor mativist theory arriv es thanks
to a global assessment of t he set of contributions that fra med the behavior, forgetting
the individual rele vance of each of the intervening par ties and what they represent for
the behavior itsel f.
