RESUMEN
El presente artículo desarrolla, de forma expositiva y analítica, la composición del sistema
judicial japonés a partir del análisis de la Constitución Política de 1946. Se centra en las
atribuciones otorgadas por la Carta Política a los jueces en Japón, así como en la
interpretación de la norma y en el papel muy conservador y “negativista” de la Corte
Suprema de Justicia como alto tribunal encargado de decretar la constitucionalidad o
inconstitucionalidad de cualquier ley, decreto, reglamento o acto oficial. La tendencia
reiterada ha sido la de “esquivar” la cuestión de constitucionalidad y de hacer prevalecer
el poder discrecional del legislador.

ABSTRACT
This article develops, in an expository and analytical way, the composition of the
Japanese judicial system from the analysis of the Political Constitution of 1946.
Moreover, it focuses on the powers granted by the Political Charter to judges in Japan, as
well as on the interpretation of the rule and the very conservative and “oppositional” role
of the Supreme Court of Justice as the high court charged with decreeing the
constitutionality or unconstitutionality of any law, decree, regulation or official act. The
repeated tendency has been to “dodge” the issue of constitutionality and to enforce the
legislator’s discretion.
